I didn't mean "legitimate" in the sense that it was illegal or not cheating, just that they were financing the construction of a new stadium at the time, and unlike what happened with Carmen Policy, members of the owners board convened in this case didn't publicly call Bowlen a liar when he made his excuses. (well, except Al Davis)

The 49ers under Policy spent a good deal of cash over the cap - by paying players underneath the table - and also by agreeing to future considerations in exchange for cap friendly contracts. I don't believe what the Donkeys did was nearly as heinous.

Which gives Steve Young's recent sermons regarding cheating in the NFL (on the Pats, the Bucs, the Phins) their own particular humor, as he was one of the main players implicated in Policy's deals.

Also, additionally I believe Taglibue penalized the 49ers twice, because it turned out that the illegality was more severe than Policy let on, before he jumped ship to Cleveland's front office. New owners took over and the NFL league office got a good look at the books during the sale.
