To answer OPs questions: The best dynamic range can be found in CMOS imagers with logarithmic response, picture related. They are used in industrial applications, i.e. to monitor automatic welding. They come close to the response of the human eye but suffer from artifacts that of yet have prohibited their use in the mainstraem market. AFAIK no company has used a color pattern such as yours. There is a patent that uses an uncovered pixel instead of the second green one of the bayer pattern to increase sensitivity by adding the monochrome information. Fucks with color accuracy though. The Fuji S5 Pro uses two differently sized pixels under the same color filter to achieve the increased dynamic range. This allows two different EVs without losing to much spatial color information. Your idea has some merrits to its own: it is easy to implement, since no redesign of the underlying sensor is neccesarry. It doesn't even need much development for the color masks, simply making the individual filters more or less thick should suffice. Needs some smart interpolation trickery though to make the image look nice at edges and high spatial frequencies. I'd say patent worthy, to bad you just published.
