Hey /p/

I'm probably going to get a lot of flames but I'm going to ask anyway.

I work for an advertisingburo and I'm currently working on an ad for a videostore. and I found this perfect photo of a couple of guys sitting in a sofa.

The thing is, it's copyrighted. so my question is the following: do I have the right to use the image if i vectorize it and change some colors here and there?

And if not, how big is the risk of someone finding out that i 'stole' the photo/used it as reference?

Or better yet, support other artists and license the photo in question from its owner. Why is it fair for you to make money creating an ad by using someone else's work who isn't getting paid for it?

And the risk is pretty high. Virgin mobile here are in deep shit for using photos they found on flicker without getting permission to use the photo or model releases or any of that.

And that's even though the picture they used was Creative Commons licensed. I.e., the license the photographer applied said they could use it.
