from what i understand though, they're basically hacking the firmware, in which case they could make it have video. I mean, you don't believe that that's a hardware feature, do you? just tell the camera to lock up the mirror and record. You probably wouldn't be able to see what the hell is going on, unless these guys are like LEGENDARY hackers and also program the firmware to have live view, which i would think is leaps harder than just making it record video. But it is possible, again, none of this requires special hardware.

writing to the card at 3 FPS at 10 MP is the same as writing to the card at 60 FPS at 720/1080p

They're just outputing the Live View buffer, which is just about VGA 64k (320x200) when cropped for 4:3. It's not anywhere near the D90/5D's capabilities so it's well within the 40D's buffer/write speed.
