Shell kicks have gone unattended numours times in the UFC and other leagues that ban down kicks. in UFC 43 with Caol Uno vs Hermes Franka, several of BJ Penn fights, i believe you can observe the shell kick in some of TUFs fights too, and they go unpunished.
The kick is hard to call becaus as you say its hard to tell wither its a set up for a sweep or sub. My point is i doubt Anderson tries to use dirty tactics. But rather there are instincts that are hard to over come, fluke accidents/circumstances. and one of the first things they tell strikers to do, when on their backs
