I used to ride my bike everywhere. Then I got t-boned by a stupid bitch trying to make an illegal left hand turn through a pedestrian intersection. Knocked me the hell out and gave me permanent amnesia. Fortunately, no broken bones or other serious injury. I cite luck, genetics, and a healthy lifestyle.
Idiot cop on the scene wrote on the accident report, "could not determine fault." This, despite 1. my blood all over the road clearly indicating where I was located when I was hit, 2. the majority of witnesses telling the cop the deal, and 3. the mere fact that automobiles are required by law to yield to bicyclists. Bitch jammed her foot on the gas trying to make it through the intersection and hit me. End of story.
Because the cop "could not determine fault," the driver's insurer took that to mean that I was partially responsible for the accident. Which in my state meant that I could not claim damages. I lawyered up, sued, and after two years of bullshit, finally got my medical bills and lawyer bills paid. Nothing for my suffering, time, broken bicycle, etc.
