Not sure this is /fit/ related but I can't seem to think where else it would really go. I was just wondering if, say, someone was trying to fight me (somewhere public not a party or bar) for no reason at all and I grabbed a baseball bat and hit him would I get charges?

As long as it's in self defense go for it, but if your planning this, make sure he gets a few good hits on you for realism, and make sure there would be a good reason for the bat to be in the place this happens... also, I hope your behind seven proxies, I would hate for this to get traced back to you.

Check your local assault laws, but in California if you are attacked first you can do anything necessary to disable your opponent and remove his ability to attack. If you continue to pummel him after he's unconscious then he has ground for a counter-suit. Make damn sure you've got witnesses if he did attack first.

yes, in california, you need to be hit first, and have plenty of witnesses

obviously public is better as you need people that are not a party to the fight(e.g. your brother would be a party if he's in the same area and saw it go down, even if he didn't do anything, as he has an interest in the case - namely you)
