Is that a Beta? If so, then dont worry about the filter or the size of the tank. it appears he has access to the surface, and that is how betas breathe.
Also, dont touch your fish. Did you change the water recently or wash the tank? You may have accidently poisioned him. I would suggest getting ahold of some declorinated water and changing his water again, as well as cleaning off his plants (plant looks kinda groddy) and rocks. Make sure not to leave any soap or chemicals on any of it! Try and keep him as stil as possible, dont move him anymore than nessicary(out of tank into a holding tank, then back into the fully clean and refreshed tank).
Are his fins gray around the edge or looky ragged? Could be fin rot: Check your local petstore for antibotics that can cure it. He may just be from poor stock and it migh be his time to go, and there may be nothing you can do about it.
If its NOT a beta: do as above, and change his water and wash everything. Also get him a filter and/or an aerator!
