Whoever told you that was a garter snake fails pretty epically. From what I can tell from the crap pic, it looks like it's keeled-scaled. And it's fairly stout-bodied, which makes me think water snake.

Fail at herpetology. Elaphe guttata, or the Red Rat snake, is more commonly known as the "Corn Snake" due to its habit of sticking close to corn fields in search of rodents. It's still a rat snake. Not all rat snakes are black. The black rat snake is a subspecies of rat snake. Red rats, black rats, yellows, Baird's, Texas, Everglade, Gray, Trans-Peco, Green-- All members of family Elaphe, all rat snakes.

if we knew what state, someone here could pin down exact species, and possibly subspecies/phase.

Except for the shape of the snout, it looks a good bit like a southern brown snake. Most places have a snake they *call* a brown snake, but there is an actual, brown snake. Usually about the size and shape of a pencil, ranging from dark brown to tan, with a lighter underbelly.

And yes, there are many rat snakes. Its a generic term to signify a snake that, gasp, usually eats rodents.
