If you attempt to approach it and it doesn't fly away, it most likely can't. I have seen birds that just choose not to fly unless it's absolutely necessary, so there's a chance it's just playing. It could have a broken wing or something - in which case one wing will probably be drooping lower than the other. I've read that you have to tend to broken wings quickly, or they'll heal wrong and the bird wont be able to fly at all anymore, so if you suspect this you should probably just try and catch him and take him to the vet. It could also just be a baby though (many young birds look as big as their parents, so it's easy to mistake it for an adult) and just hasn't learned to fly yet, in which case it should probably be left alone and it'll probably gone in a week or two.
